Planning/Zoning Board: May 11th

At the May 11 meeting of the Planning/Zoning Board, the Board heard two applications for variances:

  • The first application was by the Challenged Children’s Charity Corporation, operator of the Helen Diller Home on 26th St.  The Applicant sought a site plan waiver and a height variance for an accessory structure.  The Applicant wants to replace the tent with a permanent roof that would have a cupola for venting air out from under the roof.  The top of the cupola would be at 15.68 feet, where 12 feet is the maximum permitted.

  • The second application was by the seller of a house at 549 42nd St.  When the seller purchased the house in 2016, they had obtained a survey that indicated that the home was a conforming structure.  They recently sold the property, and the new owner had a survey that was not consistent with the seller’s survey.  Two different points of reference were used to make the measurements.  Apparently, there is no way currently to determine the correct reference point.  Consequently, the Applicant has requested a variance for a 12-foot setback for a balcony where a15-foot setback is required, and a 15-foot setback to a garage where an 18-foot setback is required.

 The Board granted both variances under the C1 hardship criteria.
