At the December 14th meeting of the Planning and Zoning Board, the Board heard a zoning litigation settlement with respect to property located on Dune Drive and 21st Street.  The former owner of the property, Andrew Buchanan, who operated the Circle Pizza and other businesses there, had been  issued numerous citations for zoning violations.  Upon refusal of the Planning and Zoning Board to rescind the citations, Buchanan sued the Borough in the Superior Court.  In October the property was bought by S. J. Guys, LLC, who entered into an agreement with the Borough that addresses the zoning infractions.  The attorneys for the new owners and for the Borough presented the changes to the property that would be required if the settlement is approved by the Borough Council.  The owner’s proposed changes basically improved parking and lighting.

 The Board accepted the changes set forth in the settlement agreement.  In January, the agreement will be submitted to the Council for final approval.
